What This Means (2025 FDD)
According to the 2025 Deer Solution Franchise Disclosure Document, a 'Competitive Business' is defined as any business that is the same as or similar to a Deer Solution Business. This includes businesses offering deer repellent services, deer damage control, and repair services.
During the term of the Franchise Agreement and any applicable renewal term, the definition of a 'Competitive Business' expands to include businesses that offer or provide services or products related to lawn care and landscaping. This means that franchisees are restricted from owning or operating businesses that directly compete with Deer Solution's core services or these additional services during the franchise term.
This definition is important for prospective franchisees as it outlines the scope of activities they are restricted from engaging in, both during the term of the agreement and potentially after termination, due to non-compete clauses. Understanding this definition is crucial for franchisees to avoid any potential conflicts of interest or breaches of the franchise agreement. It is common in the franchise industry for franchisors to define competitive businesses to protect their brand and market share.
