What This Means (2024 FDD)
According to Deck Medic's 2024 Franchise Disclosure Document, a franchisee who purchased their franchise in Washington has specific rights regarding legal actions. If litigation is not precluded by the Franchise Agreement, a Deck Medic franchisee may bring an action or proceeding in Washington under two conditions. First, the action must arise out of or be connected with the sale of franchises. Second, the action must involve a violation of the Washington Franchise Investment Protection Act.
This provision ensures that Deck Medic franchisees in Washington have a local forum to address grievances related to franchise sales and violations of the state's franchise laws. It is important to note that this right is contingent on the Franchise Agreement not precluding litigation. Franchisees should carefully review their Franchise Agreement to understand any restrictions on their ability to bring legal actions.
Furthermore, any arbitration or mediation involving a franchise purchased in Washington must occur in Washington, unless both parties agree to another location or the arbitrator/mediator determines otherwise. This requirement aims to provide a more convenient and accessible dispute resolution process for Washington franchisees. These stipulations reflect Washington's commitment to protecting franchisees' rights and ensuring fair business practices within the state.
