What This Means (2024 FDD)
According to Deck Medic's 2024 Franchise Disclosure Document, Article 2.A. of the Franchise Agreement is titled "Operating Territory". This section outlines the rights granted to the franchisee to operate their Deck Medic business within a specific geographic area.
The agreement specifies that the franchisee has the right to offer and sell services and products within their designated Operating Territory using Deck Medic's authorized service vehicles and in accordance with the standards outlined in the Operations Manual. This ensures consistency and quality across all franchise locations.
However, these rights are subject to certain conditions. The franchisee must remain in compliance with all terms of the Franchise Agreement. Additionally, the rights are non-exclusive and subordinate to any rights that Deck Medic has reserved for itself, as well as the rights of any prior users. This means that Deck Medic may still operate or grant other franchises in the same area under certain circumstances, such as reserved rights or closed markets, which could potentially impact the franchisee's business. The designation and approval of the Operating Territory by Deck Medic is crucial for these rights to be in effect.
