M 15 OBLIGATION TO PARTICIPATE IN THE ACTUAL OPERATION OF THE FRANCHISE BUSINESS**
The Franchise Agreement requires that you or, if you are a Corporate Entity, that your managing shareholder or partner be personally responsible for the daily management and supervision of the Franchised Business (the "Managing Owner"). We must approve your Managing Owner and your Managing Owner must dedicate his or her full time efforts to the management and operation of the Franchised Business and be on-site at the location of the Franchised Business facility. Your Managing Owner must have satisfactorily completed our initial training and must have obtained all required licenses and permits necessary to operate a Deck Medic Business within your Operating Territory.
You may hire a manager to assume responsibility for the daily management and supervision of the Franchised Business, only if (a) the manager meets all of our minimum standards and criteria for managers; (b) the manager completes our initial training program; (c) the manager signs our confidentiality and non-competition agreements; and (d) the manager agrees, in writing, to assume responsibility for the on-site management and supervision of the
Franchised Business. All of your employees and other agents and representatives who may have access to our confidential information must sign a confidentiality agreement. We do not require that the manager own any equity interest in the franchise.
You, and if you are a partnership or Corporate Entity, each of your members, shareholders and/or partners (collectively, "Owners"), must personally guarantee all of your obligations to us under the Franchise Agreement.

According to Deck Medic's 2024 Franchise Disclosure Document, if the franchisee is a Corporate Entity, Deck Medic requires that the managing shareholder or partner be personally responsible for the daily management and supervision of the franchised business. Deck Medic must approve the Managing Owner, who must dedicate their full-time efforts to the management and operation of the franchised business and be on-site at the location of the franchised business facility. The Managing Owner must also satisfactorily complete Deck Medic's initial training and obtain all required licenses and permits necessary to operate a Deck Medic Business within the Operating Territory.
In the event of the death or permanent disability of the Managing Owner, the remaining Owners must appoint a new Managing Owner that is approved by Deck Medic within 30 days. The appointed Managing Owner must attend and successfully complete the Training Program within 60 days of the appointment. If the Deck Medic Business is not being managed by a Deck Medic approved Managing Owner within 30 days after such death or permanent disability, Deck Medic is authorized to immediately appoint a manager to maintain the operations of the Deck Medic Business for the franchisee at the franchisee's sole costs until an approved Managing Owner is able to assume the management and operation of the Deck Medic Business.
