What This Means (2024 FDD)

According to Deck Medic's 2024 Franchise Disclosure Document, RCW 19.100.180, which is part of the Washington Franchise Investment Protection Act, may indeed supersede the standard Deck Medic Franchise Agreement. This is specifically in relation to the termination and renewal aspects of the franchise agreement for franchisees operating in Washington state. This means that certain provisions in the standard franchise agreement regarding how the franchise can be terminated or renewed might not be enforceable if they conflict with the stipulations of RCW 19.100.180. Court decisions could also supersede the Franchise Agreement in the areas of termination and renewal of your franchise.

For a prospective Deck Medic franchisee in Washington, this amendment offers a degree of protection and ensures that the franchisee's rights under Washington law are upheld. It prevents the franchisor from enforcing terms in the franchise agreement that might be less favorable to the franchisee than what is provided under Washington's Franchise Investment Protection Act. This is a significant benefit, as it provides a legal basis for challenging franchisor actions related to termination or renewal that are not in compliance with state law.

This type of state-specific amendment is common in franchise agreements to ensure compliance with local laws, which vary significantly across different states. Franchisees should be aware of these state-specific amendments, as they can substantially alter the terms and conditions of the franchise agreement. It is advisable for potential Deck Medic franchisees in Washington to carefully review the Washington Franchise Investment Protection Act and consult with an attorney to fully understand their rights and obligations regarding franchise termination and renewal.
