What This Means (2024 FDD)
According to the 2024 Deck Medic Franchise Disclosure Document, the definition of "System" includes the possibility of modifications and replacements. The FDD states that all determinations regarding the system, including its components, modifications, and replacements, are to be determined by Deck Medic in its Reasonable Business Judgment. This definition appears on page 161 of the FDD.
This means that Deck Medic retains the right to change various aspects of the franchise system. These aspects include approved services and products, system supplies, procedures, trademarks, trade dress, and the operations manual. As a franchisee, you must adhere to these changes.
The FDD also defines the Operations Manual as a collection of materials that Deck Medic can modify, add to, replace, or supplement over time. These modifications can be communicated through supplements, replacement pages, franchise bulletins, or other official pronouncements. The Operations Manual designates the approved services and products that the franchised business must offer and the system supplies that must be used exclusively.
