What This Means (2024 FDD)
According to Deck Medic's 2024 Franchise Disclosure Document, Article 18 of the Franchise Agreement, under the heading "Enforcement and Construction," is supplemented by the addition of a new subarticle 18.Y. in the state of New York. This new subarticle states that nothing in the agreement should be considered a waiver of any right conferred upon the franchisee by New York General Business Law, Sections 680-695.
This amendment is specific to franchisees operating in New York and aims to ensure that franchisees are aware that their rights under New York's franchise laws are protected and cannot be waived through the franchise agreement. This is particularly important because state franchise laws often provide franchisees with certain protections and rights that may not be explicitly stated in the franchise agreement.
Prospective Deck Medic franchisees in New York should take note of this provision, as it reinforces their rights under state law. It is advisable for franchisees to consult with legal counsel to fully understand their rights and obligations under both the franchise agreement and New York law. This ensures that franchisees are fully informed and can make sound business decisions.
