Post-Opening Obligations

- Communication of Operating Standards We may establish, update and provide you with consultations and communications as to the standards, procedures and System requirements as to the operation of your Deck Medic Business including, but not limited to, Approved Services and Products, System Supplies, marketing and promotion standards, and as we may, in our discretion, designate, modify, supplement and amend from time to time and, as set forth in the Manuals. (Franchise Agreement, Articles 4.B. and 4.C.);

- Marketing Standards and Approval We will establish, update and communicate to you our standards for the marketing and promotion of the Franchised Business including, but not limited to, the marketing media that you may use. We will respond to your request respecting the communication of our approval or disapproval of marketing media that may be requested by you for use in the marketing and promotion of the Franchised Business. We maintain full discretion as to the marketing standards and the marketing media may be used in the marketing and promotion of your Deck Medic Business (Franchise Agreement, Article 4.B.);

- Approved Vendors We will provide the names and addresses of approved vendors and suppliers for the Approved Services and Products and the System Supplies. (Franchise Agreement, Articles 4.B. and 4.C.);

- Annual System Conference We may, in our discretion, coordinate an annual conference to be attended by franchisees of the System that are in good standing. (Franchise Agreement, Article 5.D.);

- Supplemental Training We may require that you and your Operating Manager participate in supplemental onsite training that we may designate and require in our discretion. If you are not meeting what we believe to be System performance standards, we may provide, in our discretion, supplemental training on-site within your Operating Territory. You will be required to pay our then current supplemental training fee, which is currently $600 per on-site trainer per day, plus travel expenses, meals and accommodation expenses incurred by us. (Franchise Agreement, Article 4.A.);

- Initial Training for Replacement Operating Managers Your Operating Manager must complete, to our satisfaction, our initial training program. We will offer and make available to your replacement Operating Manager our initial training program which must be completed to our satisfaction. The initial training program will be provided by us at the facilities that we designate that, presently, is comprised of our affiliate owned Deck Medic Business located in Frankfort, Illinois, at the certified training Deck Medic Business that we may designate in the future, at your location or other location designated by us. You will be required to pay our then current supplemental training fee for replacement Operating Manager, which is currently $600 per manager per day for each replacement manager attending our initial training. (Franchise Agreement, Articles 4 and 7.I.);

- Administration of Marketing Funds We may administer and manage System-wide marketing funds comprised of a National Advertising Fund and/or Advertising Cooperative. (Franchise Agreement, Article 9);

- Hiring and Training of Employees We do not provide assistance with the hiring and training of your employees. You will be directly responsible for the management and supervision of your employees. For the protection of the System, you must ensure that all employees wear and maintain the proper uniforms with our approved System branded apparel and uniforms including, but not limited to, the apparel and uniforms comprising System Supplies. You must monitor and ensure that all System Supplies and Approved Services and Products are prepared, maintained, and served in accordance with the System standards and Manuals; and

- Pricing Except as to national, regional and corporate accounts that we may negotiate, you will exclusively determine the prices that you charge for the Approved Services and Products served and sold by your Deck Medic Business. However, we may suggest pricing levels that we recommend.
Advertising

- Generally All advertising, marketing, marketing materials and all marketing mediums used by you in the marketing and promotion of the Franchised Business must be pre-approved by us in writing and conform to our standards and specifications. You may only use those advertising and marketing materials and mediums that we designate and approve in writing. In our discretion we may make available to you approved marketing templates comprised of pre-approved ads, ad copy and digital media that you may utilize at your own expense. If you wish to utilize marketing materials and/or marketing mediums that are not currently approved by us in writing, you may submit a written request requesting permission and we will approve or disapprove of your request within 15 days of your submission of the written request and sample marketing materials. We are not required to conduct any advertising or spend any amount on your behalf on advertising in your operating territory. (Franchise Agreement, Article 9);

- Franchisee Directed Local Marketing You are not authorized to engage in any marketing unless it is preapproved by us, in our discretion. (Franchise Agreement, Article 9.B.). You are required to engage in local
marketing, and you are required to commit specific minimum amount of funds to your local marketing efforts. In the first year of operation, we will help you develop a plan for advertising, promotions and public relations throughout your Operating Territory and you shall make expenditures in accordance with such plan. Beginning in the second year and continuing every year thereafter, you shall spend 5% of your annual Gross Sales based on the preceding year on the local marketing of your Deck Medic Business to customers located within your Operating Territory and in accordance with our standards and specifications. We will review your local marketing programs and notify you if we approve same. We will make available to you and provide you with access, in the form of a source document, to our approved marketing campaigns, media, and messaging that may be used by you.

What This Means (2024 FDD)
According to Deck Medic's 2024 Franchise Disclosure Document, Deck Medic will establish and communicate marketing and promotion standards for franchisees, including the types of marketing media that can be used. All advertising, marketing materials, and mediums must be pre-approved in writing by Deck Medic and conform to their standards and specifications. Franchisees can only use advertising and marketing materials that Deck Medic designates and approves in writing. Deck Medic may provide approved marketing templates with pre-approved ads, ad copy, and digital media for franchisees to use at their own expense.
If a franchisee wants to use marketing materials or mediums not already approved, they can submit a written request, and Deck Medic will approve or disapprove it within 15 days. Deck Medic isn't obligated to conduct any advertising or spend any money on advertising in the franchisee's operating territory. Franchisees must engage in local marketing and commit a specific minimum amount of funds to these efforts. In the first year, Deck Medic will help the franchisee develop a plan for advertising, promotions, and public relations. Starting in the second year, franchisees must spend 5% of their annual Gross Sales from the preceding year on local marketing, following Deck Medic's standards and specifications. Deck Medic will review and approve these local marketing programs and provide access to approved marketing campaigns, media, and messaging, including source designs, copy, and design specifications, though the franchisee will bear the costs of customizing, duplicating, and using these materials.
All digital media and marketing must be approved by Deck Medic. Deck Medic will include information about the franchisee's Deck Medic Business on the www.mydeckmedic.com webpage or other designated websites. Deck Medic also has the exclusive right to authorize, establish, designate, and de-authorize local or regional advertising cooperatives in designated markets. If a cooperative is established in a franchisee's market, the franchisee must contribute to it in amounts and frequency determined by the cooperative, not exceeding 5% of monthly Gross Sales. As of the issuance date of the 2024 Disclosure Document, Deck Medic has not established any local or regional advertising cooperatives but reserves the right to do so in the future. Deck Medic has not established an advertising council but reserves the right to do so in the future.
