What are the 'Licensed Marks' that identify the Deck Medic System?
Deck_Medic Franchise · 2024 FDDAnswer from 2024 FDD Document
We license a system (the "System") for the operation of a Deck Medic business (each, a "Franchised Business" or "Deck Medic Business") that provides professional outdoor wood restoration and power washing services, as well as other services and products in accordance with our unique standards and specifications (the "Approved Services and Products"). The System includes Approved Services and Products that we currently designate and that we may modify, add to or discontinue from time to time, and our specifications, methods and procedures for the preparation, service, marketing and sale of Approved Services and Products by the Franchised Business. The System also features and requires, as designated by us, your exclusive use of products, supplies, warranties, equipment, service vehicles, and materials that we designate (the "System Supplies"). The System is identified by the Deck Medic registered trademark, registered logo, and such other trademarks, logos, and trade-dress that we may designate, modify or adopt from time to time and as same may or may not be registered with the United States Patent and Trademark Office (collectively, the "Licensed Marks"). You must develop and operate your Deck Medic Business in conformity with the specifications, procedures, criteria, and requirements that we designate in our confidential operations manual and other proprietary manuals that we designate and as we may supplement and modify from time to time (collectively, the "Manuals").

What This Means (2024 FDD)
According to Deck Medic's 2024 Franchise Disclosure Document, the 'Licensed Marks' that identify the Deck Medic System include the Deck Medic registered trademark, registered logo, and any other trademarks, logos, and trade dress that Deck Medic may designate, modify, or adopt. These marks may or may not be registered with the United States Patent and Trademark Office.
As a Deck Medic franchisee, you are required to use these Licensed Marks as part of the System. This means you must present your business to the public using these marks to ensure consistent branding and recognition. Deck Medic retains the right to modify these marks, so franchisees must stay updated with any changes to maintain compliance.
The use of registered trademarks and logos is a common practice in franchising, as it helps to create a unified brand identity across all franchise locations. This consistency is crucial for building brand recognition and customer trust. Franchisees benefit from the established reputation and goodwill associated with the brand, while the franchisor protects its intellectual property and ensures uniform quality and standards.
Prospective franchisees should be aware that they are obligated to use the specified Licensed Marks and adhere to any updates or modifications made by Deck Medic. Failure to comply with these requirements could result in a breach of the franchise agreement. It is important to review the franchise agreement carefully to understand the full scope of these obligations and any potential implications.
