What This Means (2024 FDD)
According to Deck Medic's 2024 Franchise Disclosure Document, a franchisee needs prior written consent from Deck Medic to transfer their franchise. Deck Medic has the discretion to grant or withhold this approval.
To get approval for a transfer, the Deck Medic franchisee must provide written notice to Deck Medic 30 days before the proposed transfer. The franchisee and their owners must be in compliance with all agreements with Deck Medic. The transferee must agree to be bound by the terms of the Franchise Agreement, and the transferee's owners and their spouses must personally guarantee the Franchise Agreement. The franchisee, their owners, and their spouses must sign a general release in favor of Deck Medic.
The transfer must include the assignment or ownership of the approved location for the Deck Medic business, and the transferee must continue to use and occupy that location throughout the term of the Franchise Agreement. The assets of the franchised business must be transferred to the transferee. The transferee and their owners and managers must complete Deck Medic's training programs at their own expense. Deck Medic must waive its right of first refusal and approve the transfer and transferee in writing, subject to its discretion. Finally, the franchisee must pay the Transfer Fee, subject to applicable state laws.
Deck Medic also has the right to match any offer to purchase a franchisee's Deck Medic Business or the Corporate Entity operating the Deck Medic Business. These conditions are typical in franchising, as they allow the franchisor to maintain control over who enters the system and to ensure brand consistency and quality.
