What This Means (2024 FDD)
According to Deck Medic's 2024 Franchise Disclosure Document, a franchisee's contributions to the Advertising Cooperative are capped by their local minimum marketing obligations. The document specifies that while franchisees must contribute to the Advertising Cooperative as determined by the cooperative's governing documents, these contributions cannot exceed the franchisee's local minimum marketing obligations as outlined in Article 9.B of the franchise agreement. Furthermore, any contributions made to the Advertising Cooperative will count toward fulfilling the franchisee's minimum local marketing obligations. This means that franchisees cannot be compelled to spend more on cooperative advertising than what they are already required to spend on local marketing efforts.
This provision protects Deck Medic franchisees from potentially excessive advertising fees imposed by the cooperative. It ensures that their marketing expenses remain aligned with the minimum requirements set forth in their franchise agreement. By capping the cooperative contributions at the level of local marketing obligations, Deck Medic aims to provide a degree of financial predictability and control for its franchisees.
For a prospective Deck Medic franchisee, this information is crucial for understanding the potential marketing expenses associated with the franchise. It clarifies that while participation in the Advertising Cooperative is mandatory if one is established in their area, the financial commitment is limited to the franchisee's pre-defined local marketing obligations. This can be a significant factor in assessing the overall cost and profitability of the franchise, as it prevents the cooperative from unilaterally increasing marketing expenses beyond what the franchisee has already budgeted for local marketing.
