Does the Deck Medic FDD include a list of State Administrators?
Deck_Medic Franchise · 2024 FDDAnswer from 2024 FDD Document
- The following information is added to the cover page of the Franchise Disclosure Document:
INFORMATION COMPARING FRANCHISORS IS AVAILABLE. CALL THE STATE ADMINISTRATORS LISTED IN EXHIBIT A OR YOUR PUBLIC LIBRARY FOR SERVICES OR INFORMATION. REGISTRATION OF THIS FRANCHISE BY NEW YORK STATE DOES NOT MEAN THAT NEW YORK STATE RECOMMENDS IT OR HAS VERIFIED THE INFORMATION IN THIS FRANCHISE DISCLOSURE DOCUMENT. IF YOU LEARN ANYTHING IN THIS FRANCHISE DISCLOSURE DOCUMENT IS UNTRUE, CONTACT THE FEDERAL TRADE COMMISSION AND THE APPROPRIATE STATE OR PROVINCIAL AUTHORITY. THE FRANCHISOR MAY, IF IT CHOOSES, NEGOTIATE WITH YOU ABOUT ITEMS COVERED IN THE FRANCHISE DISCLOSURE DOCUMENT. HOWEVER, THE FRANCHISOR CAN NOT USE THE NEGOTIATING PROCESS TO PREVAIL UPON A PROSPECTIVE FRANCHISEE TO ACCEPT TERMS THAT ARE LESS FAVORABLE THAN THOSE SET FORTH IN THIS FRANCHISE DISCLOSURE DOCUMENT.

What This Means (2024 FDD)
According to Deck Medic's 2024 Franchise Disclosure Document, an amendment for New York franchisees states that information comparing franchisors is available from state administrators. It directs prospective franchisees to call the state administrators listed in Exhibit A or their public library for services or information. It clarifies that registration of the franchise by New York State does not mean that New York State recommends it or has verified the information in the Franchise Disclosure Document.
This suggests that a list of state administrators may be found in Exhibit A of the FDD. This list would be useful for prospective Deck Medic franchisees, particularly those in New York, who wish to verify information or learn more about franchisors in general. It also emphasizes that state registration does not equate to endorsement of the franchise opportunity.
Prospective franchisees should check Exhibit A to confirm whether the list of state administrators is present and current. They should also note that the amendment specifically addresses the rights of franchisees in several states, indicating that franchise laws and regulations can vary significantly by location. Therefore, consulting with state administrators or legal counsel is crucial to understanding the specific protections and requirements in their area.
