What is the dependency related to modifying or discontinuing the use of materials for a Deck Medic franchise?

Answer from 2024 FDD Document

We license a system (the "System") for the operation of a Deck Medic business (each, a "Franchised Business" or "Deck Medic Business") that provides professional outdoor wood restoration and power washing services, as well as other services and products in accordance with our unique standards and specifications (the "Approved Services and Products"). The System includes Approved Services and Products that we currently designate and that we may modify, add to or discontinue from time to time, and our specifications, methods and procedures for the preparation, service, marketing and sale of Approved Services and Products by the Franchised Business. The System also features and requires, as designated by us, your exclusive use of products, supplies, warranties, equipment, service vehicles, and materials that we designate (the "System Supplies").

What This Means (2024 FDD)

According to Deck Medic's 2024 Franchise Disclosure Document, franchisees are dependent on Deck Medic's specifications, as Deck Medic has the right to modify or discontinue the use of materials. The Deck Medic system includes approved services and products that Deck Medic currently designates and may modify, add to, or discontinue from time to time. The system also requires the exclusive use of products, supplies, warranties, equipment, service vehicles, and materials that Deck Medic designates as 'System Supplies'.

This means that as a Deck Medic franchisee, you must adhere to the approved services and products, as well as the system supplies that Deck Medic dictates. Deck Medic retains the authority to change these at any time, which could impact the franchisee's operations and costs. For example, if Deck Medic decides to change the required stain product, the franchisee would be obligated to switch to the new product, potentially incurring costs for new training, disposal of old inventory, or adjustments to application techniques.

This dependency is a standard practice in franchising, where franchisors maintain control over key aspects of the business to ensure consistency and quality across all locations. However, it also means that franchisees have limited autonomy in choosing their own supplies and materials. Prospective franchisees should carefully consider this dependency and its potential impact on their business before investing in a Deck Medic franchise. It would be prudent to inquire about the frequency and nature of past changes to 'System Supplies' to better understand the potential for future disruptions.
