What This Means (2024 FDD)
According to Deck Medic's 2024 Franchise Disclosure Document, a significant consequence for a franchisee, an owner, or the franchisee's employees violating Anti-Terrorism Laws, or becoming listed on the Annex to Executive Order 13244, is the immediate termination of the Franchise Agreement by Deck Medic without prior notice.
Deck Medic requires franchisees and their owners to comply with Anti-Terrorism Laws, which include Executive Order 13224, the USA PATRIOT Act, and other federal, state, and local laws related to terrorist acts and acts of war. Franchisees and owners must certify that their property and interests are not subject to being "blocked" under these laws and that they are not in violation of any Anti-Terrorism Laws. They must also certify that they are not listed on the Annex to Executive Order 13244 and will not hire or deal with anyone so listed.
The franchisee is obligated to immediately notify Deck Medic if they or any owner becomes listed on the Annex to Executive Order 13244. Furthermore, if there is any conflict between the franchisee's obligations under the anti-terrorism laws and Deck Medic's standards or specifications, the franchisee must notify Deck Medic in writing, and Deck Medic's determination will be final.
This clause highlights the critical importance Deck Medic places on compliance with Anti-Terrorism Laws, reflecting the legal and reputational risks associated with non-compliance. Prospective franchisees should understand the gravity of these requirements and ensure they have systems in place to maintain compliance.
