Does the Deck Medic agreement allow for combining remedies available under Article 4?

According to Deck Medic's 2024 Franchise Disclosure Document, Deck Medic can combine the remedies available to them under Article 4 of the franchise agreement. Article 4 concerns Intellectual Property, Brand Protection, and Non-Competition Covenants and Restrictions.

Deck Medic states that a franchisee acknowledges that failure to comply with Article 4 will cause irreparable harm to Deck Medic and/or other Deck Medic Business franchisees, for which there is no adequate remedy at law. Therefore, Deck Medic franchisees agree that any violation of these covenants will entitle Deck Medic to injunctive relief. Deck Medic may apply for such injunctive relief, without bond, but upon due notice, in addition to such further and other relief as may be available at equity or law.

The agreement specifies that none of the remedies available to Deck Medic under Article 4 are exclusive of any other, and they may be combined. This means Deck Medic is not limited to a single course of action if a franchisee violates the terms outlined in Article 4 and can pursue multiple remedies simultaneously.
