What This Means (2024 FDD)
According to the 2024 Deck Medic Franchise Disclosure Document, several franchisee actions can lead to the termination of the franchise agreement. These include disclosing the contents of the Operations Manual or Confidential Information to unauthorized third parties. The Operations Manual contains the specific methods and standards for running a Deck Medic franchise, while Confidential Information could include proprietary business strategies, customer lists, or financial data.
Additionally, any activity that injures, harms, damages, or has a material adverse effect on Deck Medic, the Deck Medic system, the Licensed Marks, Deck Medic businesses, the franchised business, or the reputation of the Deck Medic brand can result in termination. This broad clause gives Deck Medic significant latitude to terminate the agreement if a franchisee's actions negatively impact the brand.
Further, if a franchisee, an owner, or a spouse breaches or defaults on an Ancillary Agreement (such as the Franchise Owner and Spouse Agreement and Guaranty) and fails to cure the breach in a timely manner, Deck Medic can terminate the agreement. Finally, engaging in intentionally dishonest or unethical conduct that embarrasses Deck Medic or its brand can also lead to termination, providing further protection for the brand's image and reputation. These terms highlight the importance of adhering to Deck Medic's standards and protecting its brand reputation to maintain a successful franchise.
