What This Means (2025 FDD)

According to Coffee News's 2025 Franchise Disclosure Document, franchisees are responsible for the content they post or publish on social media. This includes ensuring compliance with all applicable laws and regulations, as well as the terms and conditions of any third-party sites they use. Coffee News itself assumes no liability for a franchisee's use of social media and has no obligation to monitor a franchisee's compliance with these requirements. Franchisees are also responsible for monitoring their own employees, representatives, and agents to ensure they adhere to these policies. This extends to ensuring that all posts are truthful and not misleading.

In practical terms, this means a Coffee News franchisee must carefully review all advertising content for accuracy before it is published, whether in print or online. If an advertisement contains an error, the franchisee is responsible for correcting it and addressing any potential issues that may arise with the advertiser or the public. This responsibility includes ensuring that all endorsements and testimonials comply with the 2012 FTC Endorsement Guidelines, disclosing any compensation received for promoting a product.

This policy reflects a common practice in franchising, where franchisees are typically responsible for their own local marketing efforts and must ensure compliance with advertising regulations. While Coffee News provides guidelines and support, the ultimate responsibility for accuracy and compliance rests with the franchisee. Franchisees should establish internal procedures for reviewing and approving all advertising content to minimize the risk of errors and potential legal issues.
