- 2.6 Franchisor's Election Not to Renew. In the event Franchisor determines that Franchisee will not have the right to exercise the renewal option referred to in Section 2.1 above, and Franchisor is unwilling to renew the Franchise granted by this Agreement, Franchisor shall forward to Franchisee, not less than nine (9) months prior to expiration, a Notice of Probable Intention Not to Renew ("Notice"). Such Notice shall set forth the acts and/or omissions of Franchisee which constitute the reasons under this Agreement that Franchisor is unwilling to renew. In the event Franchisor is convinced that Franchisee is incapable of fulfilling its obligations under this Agreement, Franchisor shall then send to Franchisee a Notice of Refusal to Renew at least six (6) months prior to the expiration of this Agreement. The notice shall state the reasons for the refusal to renew and the effective date of the expiration of this Agreement. Such Notice of Refusal to Renew shall be deemed to supersede, revoke, and otherwise withdraw the option of Franchisee to renew. In the event Franchisor is satisfied that Franchisee is able to and will correct any uncured deficiencies claimed in its Notice of Probable Intention Not to Renew, Franchisee will be so advised and will be allowed to exercise its option to renew referred to in Section 2.1 above.

What This Means (2025 FDD)
Based on the 2025 Franchise Disclosure Document, the Closet Storage Concepts franchise agreement addresses conditions and notifications related to renewal, but it does not explicitly define 'Renewal Date'. However, the document outlines the circumstances under which a franchisee can exercise their renewal option and the process the franchisor follows if they choose not to renew the agreement.
To renew their Closet Storage Concepts franchise, a franchisee must meet several conditions, including updating the business to current standards, securing the location, releasing claims against the franchisor, and ensuring all payments are current. The franchisor also has the right to re-evaluate the territory size during the renewal process, which could result in adjustments to the territory's size based on demographic and market conditions.
If Closet Storage Concepts decides not to renew a franchise agreement, they must provide the franchisee with a Notice of Probable Intention Not to Renew at least nine months before the expiration date, detailing the reasons for non-renewal. If the franchisor believes the franchisee cannot fulfill their obligations, they must send a Notice of Refusal to Renew at least six months before expiration, which revokes the franchisee's renewal option. A prospective franchisee should seek clarification from the franchisor regarding the specific meaning of 'Renewal Date' within the franchise agreement to fully understand their rights and obligations.
