7.1.
Site Selection and Acceptance.
Developer is responsible for locating proposed sites for the CINNAHOLIC® Bakeries to be established hereunder.
Franchisor, in its sole discretion, may counsel and offer advice to Developer with respect to such site selection; provided, however, in no event shall Franchisor be liable to Developer in connection with providing advice or any such assistance.
Upon Developer's selection of a proposed site for a Bakery, Developer shall promptly submit to Franchisor such site, demographic and other data and information about the proposed site as reasonably requested by Franchisor, utilizing such forms as may be required by Franchisor, and a copy of any lease, sublease or purchase agreement to be entered into in connection with the acquisition of such site.

What This Means (2025 FDD)
According to Cinnaholic's 2025 Franchise Disclosure Document, the developer, or franchisee, is responsible for locating proposed sites for Cinnaholic bakeries. However, Cinnaholic may offer counseling and advice to the developer regarding site selection, but is not liable for this assistance.
Once a site is selected by the developer, they must submit site, demographic, and other data requested by Cinnaholic, including any lease, sublease, or purchase agreement. Cinnaholic then has the discretion to either accept or reject the proposed site based on their site selection policies. The acquisition of any proposed site before written acceptance by Cinnaholic is at the sole risk and responsibility of the developer and does not obligate Cinnaholic to accept the site or enter into a Franchise Agreement.
Cinnaholic's acceptance of a site does not guarantee its suitability or the success of the bakery. The suitability of a site and the success of the bakery depend on many factors outside the control of both Cinnaholic and the developer, including economic factors and the developer's efforts in operating the bakery. Cinnaholic is not obligated to provide financing or guarantee leases for site selection or development, as these activities are the exclusive responsibility of the developer.
