What This Means (2025 FDD)
According to Cinnaholic's 2025 Franchise Disclosure Document, Cinnaholic's representatives are permitted to inspect a franchisee's books and records at reasonable times. These inspections serve to verify the accuracy of reported Gross Sales, including delivery service income, and to confirm the franchisee's compliance with required advertising expenditures as outlined in the franchise agreement. The inspections also extend to any other matters related to the agreement and the operation of the Cinnaholic bakery.
Cinnaholic may also require franchisees to submit copies of their books and records for offsite inspections conducted by Cinnaholic or its representatives to audit the bakery's operations. This allows Cinnaholic to maintain oversight and ensure compliance with financial and operational standards even without a physical presence at the bakery.
If an inspection reveals that a Cinnaholic franchisee has understated their Gross Sales, the franchisee is obligated to immediately remit the outstanding Royalty Fees and Advertising Fees, along with any accrued interest as specified in the agreement. This provision underscores the importance of accurate financial reporting and the potential financial consequences of non-compliance for Cinnaholic franchisees.
