Catering and Delivery Services.

Franchisor acknowledges and agrees that Franchisee may provide catering and delivery services within a reasonable distance from the Franchised Site not to exceed 10 miles, within or without the Franchise Territory, but solely in connection with providing such catering and delivery services and provided such services are made by ground transportation.

Subject to the foregoing maximum mileage restriction, Franchisee may provide catering and delivery services in the exclusive territories of other CINNAHOLIC® franchisees, and other CINNAHOLIC® franchisees may provide the same services in the Franchise Territory.

What This Means (2025 FDD)

According to Cinnaholic's 2025 Franchise Disclosure Document, franchisees are indeed limited to ground transportation for catering and delivery services. The FDD specifies that while franchisees may offer catering and delivery within a 10-mile radius of their location, this service must be provided via ground transportation. This restriction applies both within and outside the franchisee's exclusive territory.

This limitation has practical implications for franchisees, as it restricts the methods they can use to fulfill catering and delivery orders. Franchisees must rely on vehicles such as cars, vans, or bikes for these services. They cannot use drones, boats, or other non-ground methods, even if those might be faster or more efficient in certain situations.

The FDD also notes that franchisees can provide catering and delivery services in other Cinnaholic franchisees' exclusive territories, and vice versa, subject to the 10-mile radius and ground transportation limitations. This arrangement could foster collaboration among franchisees but also introduces the potential for competition in overlapping service areas. Franchisees should carefully consider these factors when planning their catering and delivery strategies.
