What is the 'Development Area' as it relates to a Churchs Chicken Development Agreement?

Churchs_Chicken Franchise · 2025 FDD

Answer from 2025 FDD Document

In addition to a Franchise Agreement, you must sign a Development Agreement regardless of the number of Restaurants you commit to develop. A copy of our standard Development Agreement is attached as Exhibit G. Under the Development Agreement, you are granted the right and you accept the responsibility to develop a specific number of Restaurants in a specific geographic area (the "Development Area"). In some instances, we will sign an Amendment to the Development Agreement which provides limited exclusivity for the Development Area. A copy of our standard Amendment to Development Agreement is attached as Exhibit H. The Development Agreement also specifies the number of Restaurants that you must open and operate and the dates by which they must open and be in operation in a development schedule (the "Development Schedule") to the Development Agreement.

What This Means (2025 FDD)

According to Churchs Chicken's 2025 Franchise Disclosure Document, a Development Agreement grants a developer the right and responsibility to establish a specific number of restaurants within a defined geographic area, referred to as the "Development Area." This agreement is required regardless of the number of restaurants the developer commits to opening. In some cases, Churchs Chicken may provide limited exclusivity for the Development Area through an amendment to the Development Agreement.

The Development Agreement also includes a "Development Schedule," which outlines the number of Churchs Chicken restaurants the developer must open and operate, along with the specific dates by which each restaurant must be operational. This schedule ensures that the developer adheres to an agreed-upon timeline for expanding the Churchs Chicken brand within their designated area.

For a prospective Churchs Chicken franchisee, understanding the Development Area is crucial. It defines the geographic scope of their expansion rights and obligations. The Development Schedule dictates the pace at which they must open new restaurants, impacting their investment timeline and potential revenue streams. The possibility of securing limited exclusivity within the Development Area can provide a significant competitive advantage, but this is not guaranteed and is subject to negotiation with Churchs Chicken.
