What This Means (2024 FDD)
According to the 2024 Chocolate Fish Coffee Franchise Agreement, franchisees must display specific signage at their business location. The franchisee is required to display signage that Chocolate Fish Coffee prescribes, which identifies the location as an independently owned franchise.
In addition to the initial signage, Chocolate Fish Coffee retains the right to modify or discontinue any of the Marks used under the system. If any such changes occur, the franchisee is responsible for complying with these changes within a reasonable time frame, and at their own expense. This may include replacing obsolete or worn-out signage as Chocolate Fish Franchising may prescribe from time to time.
Upon termination or expiration of the franchise agreement, the franchisee is obligated to remove all Chocolate Fish Coffee signage and de-identify the location within 30 days. This ensures that the location no longer contains any of the brand's trademarks, signage, or trade dress. Failure to do so allows Chocolate Fish Coffee to enter the location and remove the Marks and de-identify the location at the franchisee's expense.
