How will Chocolate Fish Coffee Franchising provide advice to franchisees?

On-Site Opening Assistance. Chocolate Fish Franchising shall have a representative support Franchisee's business opening with one week of onsite opening training and assistance.
5.5 Post-Opening Assistance.
- (a) Advice, Consulting, and Support. If Franchisee requests, Chocolate Fish Franchising will provide advice to Franchisee (by telephone or electronic communication) regarding improving and developing Franchisee's business, and resolving operating problems Franchisee encounters, to the extent Chocolate Fish Franchising deems reasonable. If Chocolate Fish Franchising provides in-person support in response to Franchisee's request, Chocolate Fish Franchising may charge its then-current fee plus any out-of-pocket expenses (such as travel, lodging, and meals for employees providing onsite support).
- (b) Pricing. Upon request, Chocolate Fish Franchising will provide recommended prices for products and services offered by franchisees of the System.
- (c) Procedures. Chocolate Fish Franchising will provide Franchisee with Chocolate Fish Franchising's recommended administrative, bookkeeping, accounting, and inventory control procedures. Chocolate Fish Franchising may make any such procedures part of required (and not merely recommended) System Standards.
- (d) Marketing. Chocolate Fish Franchising shall manage the Brand Fund.
- (e) Internet. Chocolate Fish Franchising shall maintain a website for Chocolate Fish Coffee, which will include Franchisee's location (or territory) and telephone number.
ARTICLE 6. LOCATION, DEVELOPMENT, AND OPENING
6.1 Determining Location and Territory.
- (i) Franchisee shall find a potential Location within the Development Area described on the Summary Page. Franchisee shall submit its proposed Location to Chocolate Fish Franchising for acceptance, with all related information Chocolate Fish Franchising may request. If Chocolate Fish Franchising does not accept the proposed Location in writing within 30 days, then it is deemed rejected.

What This Means (2024 FDD)
According to Chocolate Fish Coffee's 2024 Franchise Disclosure Document, Chocolate Fish Coffee Franchising offers several avenues of advice and support to its franchisees. After the franchise location opens, Chocolate Fish Coffee Franchising will provide advice to the franchisee via telephone or electronic communication if the franchisee requests it. This advice will pertain to improving and developing the franchisee's business, as well as resolving any operational problems that may arise. However, the provision of this advice is subject to Chocolate Fish Franchising deeming it reasonable to provide. If in-person support is requested and provided, Chocolate Fish Franchising may charge a fee for this service, in addition to covering out-of-pocket expenses such as travel, lodging, and meals for the employees providing the support.
Chocolate Fish Coffee Franchising also offers pre-opening assistance to franchisees. This includes advising on the planning and execution of the franchisee's market introduction plan. Furthermore, Chocolate Fish Coffee Franchising will provide its criteria for Chocolate Fish Coffee locations and will review and advise the franchisee regarding potential locations that the franchisee submits for consideration.
In addition to advice, Chocolate Fish Coffee Franchising will make its manual available to franchisees. They will also provide suggested staffing levels and guidelines for hiring employees, though all hiring decisions and employment conditions remain the franchisee's sole responsibility. Chocolate Fish Coffee Franchising will also provide programs for franchisees to conduct training of new employees, to the extent that Chocolate Fish Coffee Franchising deems it appropriate. Chocolate Fish Coffee Franchising will also provide recommended administrative, bookkeeping, accounting, and inventory control procedures, which may become required System Standards.
