What This Means (2024 FDD)
According to the 2024 Chocolate Fish Coffee Franchise Disclosure Document, a franchisee is not entitled to the same System Standard variations or waivers as other franchisees. Chocolate Fish Franchising retains the right to vary or waive any System Standard for individual franchises based on specific factors. These factors include the peculiarities of the site, circumstances, population density, business potential, trade area population, existing business practices, applicable laws or regulations, or any other condition relevant to the performance of a franchise or group of franchises.
This means that Chocolate Fish Coffee has the flexibility to adapt its standard operating procedures to suit the unique conditions of each location. However, it also implies that franchisees cannot expect to receive the same treatment or exceptions as others. The decision to grant a variation or waiver is solely at the discretion of Chocolate Fish Franchising.
For a prospective Chocolate Fish Coffee franchisee, this highlights the importance of understanding the specific market and location they are considering. While some flexibility exists, franchisees should not assume they can negotiate changes to the System Standards. It would be prudent to discuss any potential needs for variation with Chocolate Fish Coffee during the due diligence process to gauge the likelihood of obtaining such a waiver.
