What This Means (2024 FDD)
According to Chocolate Fish Coffee's 2024 Franchise Disclosure Document, the franchise agreements themselves do not vary by state. However, the document indicates that Chocolate Fish Coffee may register its Disclosure Document in some or all states in accordance with applicable state law. When the company pursues franchise registration or otherwise complies with franchise investment laws in these states, state administrators become responsible for the review, registration, and oversight of franchises in each state. The FDD also states that local law requirements vary by location.
This means that while the core franchise agreement is standardized, franchisees must comply with all federal, state, and local regulations applicable to the restaurant business and employment. These include laws pertaining to food handling and safety, liquor, food labeling, sanitation, weights and measurements, minimum wage, and wage requirements. Franchisees may also need to obtain restaurant, business, occupational, and food handling licenses, which can vary by state.
Prospective franchisees should consult with their own advisors and government agencies to understand how these laws apply to their specific location. While the franchise agreement itself may not change, the operational requirements and necessary licenses will depend on the state and local regulations where the Chocolate Fish Coffee franchise is located. This is a common practice in franchising, as businesses must adhere to local laws and regulations, which can significantly impact day-to-day operations.
