Chesters Franchise · 2025 FDD

Answer from 2025 FDD Document

RCW 49.62.060 prohibits a franchisor from restricting, restraining, or prohibiting a franchisee from (i) soliciting or hiring any employee of a franchisee of the same franchisor or (ii) soliciting or hiring any employee of the franchisor.

As a result, any such provisions contained in the franchise agreement or elsewhere are void and unenforceable in Washington.

What This Means (2025 FDD)

According to Chesters's 2025 Franchise Disclosure Document, if a Chesters franchise is located in Washington, Chesters is prohibited from restricting a franchisee from soliciting or hiring any employee of Chesters. This protection is explicitly stated under RCW 49.62.060, the Revised Code of Washington. Any clause within the franchise agreement that attempts to prevent a franchisee from soliciting or hiring Chesters's employees is considered void and unenforceable in Washington state. This addendum modifies the franchise agreement to comply with Washington law.

This means that a Chesters franchisee in Washington has the right to recruit and hire employees directly from Chesters's corporate operations or from other Chesters franchisees. This can be a significant advantage for franchisees looking to quickly staff their locations with experienced personnel who are already familiar with the Chesters system. It also provides Chesters employees with more career opportunities within the franchise network.

However, franchisees should be aware that this right also means their own employees could be targeted by Chesters or other franchisees for recruitment. While Washington law protects the franchisee's right to solicit and hire, it does not prevent Chesters or other franchisees from doing the same. Franchisees should focus on creating a positive work environment and competitive compensation packages to retain their best employees.

This type of provision is not uncommon in franchise agreements, as state laws often aim to protect the rights and opportunities of both franchisees and employees. Prospective Chesters franchisees in Washington should carefully review this addendum and understand their rights and responsibilities regarding employee solicitation and hiring.
