Are non-Chester's food-service operators who purchase chicken cooking equipment from Chesters allowed to use Chesters' trademarks?
Chesters Franchise · 2025 FDDAnswer from 2025 FDD Document
Besides what we describe above, we sell and may continue to sell equipment to franchisees and have begun selling clothing and merchandise on the Internet, and BirdShack sells and may continue to sell consumable products (breading, etc.), to food or equipment distributors (as applicable) or directly to restaurant operators that compete with you, although these other operators will not use any trademarks owned by us or our affiliates (other than BirdShack).

What This Means (2025 FDD)
According to Chesters's 2025 Franchise Disclosure Document, non-Chester's food-service operators who purchase chicken cooking equipment from Chesters are not allowed to use Chesters' trademarks. Chesters may sell chicken cooking equipment to these operators, but they do not gain the right to use any of Chesters' trademarks.
Instead, these non-Chester's food-service operators must sell chicken products under their own trade names and brands. This is similar to the arrangement Chesters has with BirdShack, an affiliate that sells chicken-related food products to non-Chester's operators. These operators also do not have the right to use Chesters' trademarks and must sell under their own brands or the BirdShack name.
This policy ensures that the Chesters brand remains exclusive to its franchisees and licensed restaurants, preventing confusion among customers and maintaining brand integrity. It also allows Chesters to expand its reach by selling equipment and products to a wider range of food-service businesses without diluting its brand.
