What This Means (2024 FDD)
According to C3 Wellness Spa's 2024 Franchise Disclosure Document, the Practice can directly employ Non-Medical Personnel if the Practice and the Manager specifically agree to it in writing. Typically, Non-Medical Personnel are employed by the Manager and then leased to the Practice. However, this arrangement can be altered.
If the Practice directly employs or contracts with Non-Medical Personnel, these personnel would be considered employees or independent contractors of the Practice. In this case, the Practice would have control over the selection process, the terms of employment or engagement, including compensation rates, supervision, direction, training, and assignment of duties.
This written agreement provides flexibility in staffing arrangements, allowing the C3 Wellness Spa franchisee (the Practice) and the Manager to tailor their relationship to best suit their operational needs. It also gives the franchisee more direct control over certain personnel if both parties agree it is beneficial.
