Can a C3 Wellness Spa franchisee market without pre-approval?

Local Marketing You are not authorized to engage in any marketing unless it is pre-approved by us, in our discretion. (Franchise Agreement, Article 9.B).
You are required to spend not less than 2% of your monthly Gross Sales on the local marketing of your Spa Location Franchise.
We will review your local marketing programs and notify you if we approve same.
We will make available to you and provide you with access, in the form of a source document, to our approved marketing campaigns, media, and messaging that may be used by you.
In those instances where we provide you with access to our marketing campaigns, we provide you with the source designs, copy, and design specifications.
However, you will incur the direct costs associated with customizing, duplicating and using such marketing campaigns and in having them printed, distributed and/or placed with media sources. (Franchise Agreement, Article 9);
Digital Media and Website All digital media and marketing must be approved by us.

What This Means (2024 FDD)
According to C3 Wellness Spa's 2024 Franchise Disclosure Document, franchisees are not authorized to engage in any marketing unless it is pre-approved by C3 Wellness Spa. This includes all advertising, marketing materials, and marketing mediums. Franchisees must utilize only those advertising and marketing materials and mediums that C3 Wellness Spa designates and approves in writing.
C3 Wellness Spa may make available approved marketing templates comprised of pre-approved ads, ad copy, and digital media that franchisees may use at their own expense. If a franchisee wants to use marketing materials or mediums not already approved, they must submit a written request for permission. C3 Wellness Spa will then approve or disapprove the request within 30 days of submission, including sample marketing materials.
Franchisees are required to spend a minimum of 2% of their monthly Gross Sales on local marketing for their Spa Location Franchise. C3 Wellness Spa will review these local marketing programs and notify franchisees of their approval. The franchisor will also provide access to approved marketing campaigns, media, and messaging, including source designs, copy, and design specifications. However, the franchisee will bear the costs of customizing, duplicating, and using these marketing campaigns, including printing, distribution, and media placement. All digital media and website marketing must also be approved by C3 Wellness Spa.
