obtaining such approval is prescribed, Franchisee shall request such approval in writing, and Franchisor shall respond within 10 business days after receiving Franchisee's written request and all supporting documentation, provided if Franchisor does not respond, such request shall be deemed unapproved. Franchisor's consent to, or approval of, any act or request by Franchisee shall be effective only to the extent specifically stated, and Franchisor's consent or approval shall not be deemed to waive, or render unnecessary, consent or approval of any other subsequent similar act or request.

What This Means (2024 FDD)
According to the 2024 C3 Wellness Spa Franchise Disclosure Document, the definition of the Development Area is found within the Development Information Sheet. This sheet is part of the Multi-Unit Development Agreement between Aryes Franchising LLC (the franchisor) and the franchisee.
The Development Information Sheet specifies the Development Area, which is to be completed and signed by the franchisor to be effective. The franchisee is responsible for meeting the requirements of the Development Schedule, including the number of spas that must be developed, established, opened, and in operation within the Development Area by specific Development Periods. The franchisee must also execute the then-current standard Franchise Agreement for each C3 Wellness Spa they own, develop, and open within the Development Area.
The franchisee acknowledges that they have independently investigated the prospects for establishing spa locations within the Development Area and that the Development Schedule is reasonable. Failure to meet the Development Schedule constitutes a material breach of the agreement. The Development Area Fee and the total number of spas to be developed are also specified in the Development Information Sheet.
