How is the Buona Protected Area defined if the Approved Location is in a non-urban area?

The Buona Protected Area will be a geographic area around the Approved Location with a minimum people population of Sixty Thousand (60,000) if the Approved Location is in a non-urban location and a one-half (1/2) mile radius around the Approved Location if it is located in an urban area.
Upon determination of the Approved Location, Franchisor and Franchisee shall complete and execute Exhibit A with a description of the Buona Protected Area.

What This Means (2025 FDD)
According to Buona's 2025 Franchise Disclosure Document, the Buona Protected Area for a location in a non-urban area is defined by a minimum population of 60,000 people. The franchise agreement includes Exhibit A, which will contain a description of the Buona Protected Area. Once the Approved Location is determined, both Buona and the franchisee must complete and execute Exhibit A.
However, the protected area has limitations. Buona retains the right to franchise or operate businesses, and distribute products and services of the system, within the Buona Protected Area in specific locations. These "Captive Locations" include transportation facilities, educational facilities, institutional feeding facilities, government institutions, enclosed shopping malls, entertainment venues including casinos, sports stadiums, and amusement or theme parks.
It's important to note that the franchisee does not receive a protected area, nor any exclusive rights, related to The Original Rainbow Cone portion of the franchised business. Also, Buona and third parties designated by Buona can solicit prospective National Accounts within the franchisee's Buona Protected Area. If the franchisee declines to participate in the National Accounts Program, or cannot service a National Account, Buona can provide services to National Account locations within the franchisee's protected area without violating the agreement.
