What This Means (2025 FDD)
According to Buona's 2025 Franchise Disclosure Document, after the termination or expiration of the franchise agreement, the franchisee must take specific actions regarding identifiers used for the business. These identifiers, which Buona defines as telephone numbers, fax numbers, directory listings, email addresses, social media accounts, websites, internet addresses and other online presences, are considered Buona's assets. Within five days of termination or expiration, the franchisee must assign all rights and interests in these identifiers to Buona or its designee.
This includes notifying all relevant service providers, such as telephone companies, listing agencies, internet service providers, domain name registrars, and social media platforms, about the termination of the franchisee's right to use these identifiers. The franchisee must authorize the transfer of these identifiers to Buona or its designated party.
Furthermore, the franchisee is obligated to provide Buona with any passwords or account manager access information necessary to manage these identifiers. This ensures that Buona can maintain control over the online presence and contact information associated with the brand, preventing any potential confusion or misuse after the franchise agreement ends. This requirement is fairly standard in franchising, as franchisors need to protect their brand identity and customer relationships.
