Upon approval of Franchisee's location by Franchisor, Franchisor and Franchisee shall execute Exhibit A attached hereto which will identify the Approved Location.

What This Means (2025 FDD)
According to Buona's 2025 Franchise Disclosure Document, upon the franchisor's approval of a franchisee's location, Buona and the franchisee will execute Exhibit A of the franchise agreement. Exhibit A serves to identify the Approved Location for the Buona restaurant.
Exhibit A also includes a description of the Buona Protected Area. The Protected Area is determined based on whether the Approved Location is in an urban or non-urban setting. For non-urban locations, the Protected Area will have a minimum population of 60,000 people. For urban locations, the Protected Area will extend a one-half (1/2) mile radius around the Approved Location.
It is important to note that the franchisee does not receive a protected area, nor any exclusive rights, regarding The Original Rainbow Cone portion of the Franchised Business. Additionally, the Protected Area may be subject to certain limitations, such as captive locations like transportation facilities, educational facilities, or enclosed shopping malls, where Buona retains the right to operate or franchise other businesses.
