  • (h) Business Interruption Insurance, covering Franchisee's loss of revenues and

ongoing expenses and to cover any amounts due and owing to Franchisor under this Agreement, including but not limited to the royalties, Marketing Fund contributions, and technology fees that would have been made by Franchisee had the business interruption not occurred, based upon the average of receipts of the Franchised Business for the trailing twelve months prior to the interruption, in an amount not less than the actual loss resulting from an interruption of business for a minimum of twelve (12) months; to be obtained prior to the opening of the Franchised Business;

  • (i) Cyber Insurance, covering breach, system failure, extortion and crime coverage with a limit of $1,000,000 each occurrence and in the aggregate; to be obtained prior to the installation and use of the computer system for the Franchised Business;
  • (j) PCI DSS Liability coverage with a limit of $1,000,000 each occurrence and in the aggregate; to be obtained prior to the opening of the Franchised Business.
  • 12.3 Additional Insurance Requirements. All such policies of insurance shall be placed with an insurance company that has a claims rating ability of at least A- from A.M. Best and shall provide that the same shall not be canceled, modified or changed without first giving thirty (30) days' prior written notice thereof to Franchisor. What This Means (2025 FDD)

According to Buona's 2025 Franchise Disclosure Document, franchisees must obtain cyber insurance prior to the installation and use of the computer system for the franchised business. This cyber insurance should cover breach, system failure, extortion, and crime, with a limit of $1,000,000 per occurrence and in the aggregate.

In addition to cyber insurance, Buona franchisees are also required to obtain PCI DSS Liability coverage with a limit of $1,000,000 per occurrence and in the aggregate, which must be obtained prior to opening the franchised business.

Buona requires that all insurance policies be placed with an insurance company that has a claims rating ability of at least A- from A.M. Best. Furthermore, Buona must receive 30 days' prior written notice before any policy is canceled, modified, or changed. Franchisees are responsible for paying any deductibles from insured claims. Certificates of insurance, including renewals, must be delivered to Buona to satisfy these requirements.
