What This Means (2025 FDD)
According to Buona's 2025 Franchise Disclosure Document, the Franchise Acknowledgement Questionnaire does indeed ask prospective franchisees if they have received the completed Franchise Agreement and all attached exhibits. This questionnaire is designed to ensure that franchisees have had ample opportunity to review all the necessary documents before entering into the agreement.
Specifically, the questionnaire requires a 'yes' or 'no' answer to the question of whether the franchisee has received the completed Franchise Agreement and its exhibits. If a franchisee answers 'no' to this question or any other question on the form, they are required to provide an explanation. This process helps Buona confirm that franchisees are fully informed about the terms and conditions of the franchise agreement before signing.
It is important to note that prospective franchisees residing in or intending to operate in California are instructed not to complete the questionnaire. This may be due to specific state regulations or requirements. Additionally, the questionnaire cannot be signed on the same day as the receipt for the Franchise Disclosure Document but must be signed on the same day as the Franchise Agreement. This timing is likely intended to ensure that franchisees have adequate time to review the FDD before completing the questionnaire and signing the agreement.
