Compliance with the foregoing shall be a condition subsequent to Franchisor's approval of any relocation request by Franchisee, and in the event complete de-identification of the former Franchised Business premises is not properly and completely undertaken, Franchisor may then revoke its permission for relocation and declare a default under this Agreement.

What This Means (2025 FDD)

According to Buona's 2025 Franchise Disclosure Document, a condition subsequent to Buona's approval of a franchisee's relocation request is the complete de-identification of the former franchised business premises. This means the franchisee must ensure that all signage, branding, and other identifying marks of Buona are removed from the original location after relocation.

If the franchisee fails to properly and completely de-identify the former premises, Buona has the right to revoke its permission for the relocation. Additionally, Buona can declare the franchisee to be in default of the franchise agreement.

This condition protects Buona's brand and prevents potential confusion or misrepresentation that could arise if the former location continues to display Buona's branding after the business has moved. It is a fairly standard practice in franchising to ensure brand consistency and prevent unauthorized use of trademarks.
