What This Means (2025 FDD)
According to Buona's 2025 Franchise Disclosure Document, a 'website' is defined as a collection of related web pages, including multimedia content, accessible via the Internet. This definition applies to websites that Buona operates or authorizes others to operate, and which refer to the Buona Businesses, the Marks, Buona, and/or the System. This definition is important because it clarifies the scope of Buona's control and the franchisee's restrictions regarding online presence.
Buona retains sole control over the official Buona Website and any linked pages for a franchisee's business. Franchisees are strictly prohibited from creating or maintaining any websites or domain names that incorporate Buona's trademarks, names, or initials in the web address without prior written authorization. This restriction ensures brand consistency and prevents unauthorized use of Buona's intellectual property.
Buona also controls all aspects of digital marketing, including those related to a franchisee's business. Franchisees need written consent from Buona to engage in any digital marketing activities that use Buona's trademarks or relate to their franchised business. If consent is granted, franchisees must adhere to Buona's guidelines and standards for digital marketing. This centralized control allows Buona to maintain a consistent brand image and marketing strategy across all franchise locations.
Prospective franchisees should be aware that Buona also has the sole right to develop mobile applications using its trademarks. This further limits the franchisee's ability to independently market or promote their business through digital channels. Franchisees should discuss with Buona the extent to which they can participate in or influence the content and marketing strategies related to their specific franchise location.
