What This Means (2025 FDD)
According to the 2025 Bumper Man Franchise Disclosure Document, there are several addenda that may be executed depending on the circumstances. One addendum, the Certified Technician Addendum, is executed when a franchisee requests Bumper Man's consent to retain a certified technician to perform services within the designated area to maximize the number of customers serviced by the Bumper Business. This addendum is effective as of a specific date agreed upon by Bumper Man, the franchisee, the principal, and the certified technician.
Other addenda are executed pursuant to specific state franchise laws. For example, if the offer or sale of the franchise was made in Maryland, if the franchisee is a resident of Maryland, and/or if the Bumper Business will be operated in Maryland, an addendum to the franchise agreement pursuant to the Maryland Franchise Registration and Disclosure Law is executed. Similarly, there are addenda for Illinois and Rhode Island, triggered by offering or selling a franchise in those states, franchisee residency, or the Bumper Business location.
These addenda modify specific sections of the standard Bumper Man Franchise Agreement to ensure compliance with state laws. For example, the Maryland addendum supplements sections of the agreement related to releases, termination, legal actions, and waivers to align with Maryland franchise law. The Illinois addendum modifies sections regarding default, termination, governing law, and stipulations to comply with the Illinois Franchise Disclosure Act. The Rhode Island addendum addresses restrictions on jurisdiction, venue, and the application of other states' laws, as prohibited by the Rhode Island Franchise Investment Act. These addenda are integral parts of the Franchise Agreement and are incorporated into it to ensure compliance with local regulations.
