- Designated Area, so long as Franchisee's Designated Area contains a minimum of 35 Major Dealerships; or (ii) offer the opportunity for Franchisee to retain the services of a Certified Technician that satisfies Franchisor's then-current criteria for Certified Technicians and is approved by Franchisor in writing within 30 days of Franchisor's Notice of intent to modify the Designated Area. If Franchisor offers the opportunity for Franchisee to retain the services of a Certified Technician, then within 60 days following Franchisor's approval of Franchisee's Certified Technician, Franchisee and the Certified Technician will execute Franchisor's current form of Certified Technician Addendum and the Certified Technician will pay the Certified Technician Fee and complete Initial Training.

According to the 2025 Bumper Man Franchise Disclosure Document, Bumper Man franchisees may have the option to retain the services of a certified technician. If a franchisee chooses to do so, both the franchisee and the certified technician will execute Bumper Man's current Certified Technician Addendum form. The franchisor must provide written approval of the technician within 30 days of notice of intent to modify the designated area.
The Certified Technician Addendum outlines the terms and conditions under which the franchisee and the certified technician will operate the Bumper Man business. The franchisee is responsible for ensuring the technician complies with the Franchise Agreement terms, including standards for performing services, following applicable laws, and protecting confidential information and intellectual property.
The franchisee and certified technician are jointly and severally liable for any losses or expenses incurred by customers due to the technician's actions, negligence, or misconduct. The franchisee must also indemnify Bumper Man against any claims arising from the relationship with the certified technician or the technician's operation of the business.
The addendum has a term of two years, which can be renewed for two consecutive two-year terms if the certified technician meets Bumper Man's requirements. If the franchisor does not exercise its right of first refusal to purchase the Bumper Business, the certified technician has the option to purchase the business by entering into Bumper Man's current Franchise Agreement and paying an initial franchise fee, less the Certified Technician Fee.
