What This Means (2025 FDD)

According to the 2025 Bumper Man Franchise Disclosure Document, a franchisee's unauthorized use of the Marks constitutes an Event of Default under the franchise agreement. This includes misuse of the Marks on social media pages, other internet sites, or registering a domain name incorporating the Marks.

Bumper Man retains sole ownership of all rights, titles, and interests in any intellectual property related to the operation of the Bumper Business. The franchisee's right to use the Marks is derived solely from the franchise agreement and is limited to operating the Bumper Business in compliance with the agreement. The franchisee's use of the Marks and any associated goodwill will exclusively benefit Bumper Man, and the agreement does not grant the franchisee any goodwill or other interests in the Marks.

Specifically, the franchisee must use the Marks as the sole identification of the Bumper Business and identify themselves as the independent owner in the manner Bumper Man prescribes. The franchisee cannot use any Mark as part of any entity name or with any prefix, suffix, or other modifying elements, unless expressly authorized in writing by Bumper Man. Unauthorized use of the Marks will be considered an infringement of Bumper Man's rights.
