- (uu) "Marks" means the Bumper Man, Inc. trademarks and service marks and such other registered and unregistered trademarks, trade names, service marks, logos, slogans, emblems and other indicia of origin as are now designated, and may hereafter be designated, by Franchisor in writing for use in connection with the System.

According to the 2025 Bumper Man Franchise Disclosure Document, the term "Marks" encompasses the Bumper Man, Inc. trademarks and service marks, along with any other registered and unregistered trademarks, trade names, service marks, logos, slogans, emblems, and other symbols of origin. These marks are designated by Bumper Man in writing for use in connection with the Bumper Man system.
As a Bumper Man franchisee, you are required to use the Marks as the sole identification for your Bumper Business, but you must also identify yourself as the independent owner in a manner prescribed by Bumper Man. You are restricted from using any Mark as part of an Entity name or with modifications unless expressly authorized in writing by Bumper Man. This includes prohibitions on using the Marks in domain names, electronic addresses, metatags, or on websites without explicit written permission from Bumper Man.
The Franchise Agreement specifies that Bumper Man retains ownership of all intellectual property rights related to the Bumper Business. Upon termination or expiration of the franchise agreement, franchisees are required to discontinue all use of the Marks and take actions to cancel any assumed names related to the use of any Mark. This ensures a clear separation and prevents any confusion in the marketplace after the franchise relationship ends.
