Answer from 2025 FDD Document

Franchisee will at all times operate the Bumper Business in full compliance with Applicable Law. Franchisee must notify Franchisor in writing immediately upon the commencement of any legal action, suit, or proceeding, any administrative action, or the issuance of an order of any court, agency, or other governmental instrumentality, which may adversely affect the operation of the Bumper Business or Franchisee's financial condition; or the delivery of any notice of violation or alleged violation including arrest of Franchisee (if Franchisee is an individual) or Franchisee's Operating Principal (if Franchisee is an Entity) of any Applicable Law, including those relating to health or safety. Franchisee will refrain from any business or advertising practice which may be injurious to Franchisor's business, to the business of other Bumper Man businesses, or to the goodwill associated with the Marks, provided, however, that nothing in this Section 9(b) or elsewhere in this Agreement restricts or is intended to restrict Franchisee's communications with any state or federal law regulator or enforcement authority about potential violations of law. Franchisee will be solely responsible for procuring and continuously maintaining thereafter all approvals, permits, and/or licenses required for the operation of the Business.

What This Means (2025 FDD)

According to the 2025 Bumper Man Franchise Disclosure Document, franchisees are solely responsible for obtaining and maintaining all necessary approvals, permits, and licenses required to operate their Bumper Man business. This means that the franchisee must handle all aspects of securing these items, ensuring they are current and compliant with applicable laws throughout the duration of their franchise agreement.

This requirement places a significant administrative and legal burden on the franchisee. They must research and understand all local, state, and federal regulations that apply to their specific Bumper Man business. This includes identifying which permits and licenses are needed, completing the application processes, and paying any associated fees. Failure to comply with these regulations can result in fines, penalties, or even the suspension of their business operations.

Furthermore, the franchisee is obligated to inform Bumper Man immediately in writing if any legal or administrative actions are initiated against them, or if they receive notice of any violation that could negatively impact their business or financial standing. This includes any issues related to health or safety regulations. This ensures that Bumper Man is aware of any potential problems and can offer support or guidance, although the ultimate responsibility for resolving the issue rests with the franchisee.

In the franchise industry, it is common for franchisees to be responsible for obtaining and maintaining their own permits and licenses, as local regulations can vary significantly. However, prospective Bumper Man franchisees should carefully consider the time and resources required to fulfill these obligations and factor them into their overall business plan.
