What This Means (2025 FDD)
According to the 2025 Bumper Man Franchise Disclosure Document, a franchisee is required to display the Marks, which are the Bumper Man trademarks and service marks, in specific locations as prescribed by the franchisor. These locations include the Bumper Business itself, ensuring that the business is clearly identified as a Bumper Man franchise. Additionally, the Marks must be displayed on supplies and materials that the franchisor designates, maintaining brand consistency in all operational aspects.
Furthermore, the Marks should be present on forms, advertising, and marketing materials used by the franchisee. This ensures that all customer-facing communications and promotional efforts reinforce the Bumper Man brand. However, the franchisee's use of the Marks is limited and must be in compliance with the franchise agreement. The franchisee must also identify themselves as the independent owner of the business in a manner prescribed by Bumper Man.
Unauthorized use of the Marks by the franchisee constitutes an event of default under the agreement and an infringement of the franchisor's intellectual property rights. This includes using the Marks in any way not expressly authorized in writing by Bumper Man, such as in domain names or on websites without permission. The franchisor retains control over how the Marks are used to protect the brand's integrity and goodwill.
