What This Means (2025 FDD)
According to the 2025 Bumper Man Franchise Disclosure Document, a 'Competitive Business' is defined to include businesses that offer repair services to a vehicle's exterior. This definition specifically encompasses services like dent repair, refinishing, and restoration of both painted and non-painted exterior surfaces. It also extends to any Designated Services and the related offering and sale of products.
This definition has significant implications for a Bumper Man franchisee. It means that during the term of the franchise agreement, the franchisee is restricted from owning or operating any business that directly competes with Bumper Man's core services. This restriction is in place to protect Bumper Man's market share and prevent franchisees from diverting resources or expertise to competing ventures.
However, the definition of 'Competitive Business' does have some exceptions. It does not include other businesses that are licensed by Bumper Man or its affiliates, or the franchisee's existing brands. This allows franchisees to engage in other business activities that do not directly compete with the Bumper Man franchise. Franchisees should carefully review this definition and its exceptions to ensure they understand the scope of the competitive restrictions.
Prospective franchisees should seek clarification from Bumper Man regarding any specific business activities they plan to pursue outside of the franchise to ensure they do not violate the terms of the franchise agreement. Understanding these restrictions is crucial for avoiding potential conflicts and maintaining a positive relationship with the franchisor.
