8. TERM OF ADDENDUM.
- (a) Term. The term of this Addendum will commence on the Effective Date of this Addendum and will expire two years thereafter, unless this Addendum or the Franchise Agreement is terminated as provided in Section 18 of the Franchise Agreement. For the sake of clarity, this Addendum will terminate immediately upon the expiration, termination or Transfer of the Franchise Agreement. The grounds for termination of the Franchise Agreement appear in Exhibit C.
- (b) Renewal. Certified Technician may, at its option, continue to operate the Bumper Business pursuant to this Addendum and the Franchise Agreement for two consecutive two-year terms, subject to Certified Technician's satisfaction of the conditions required by Franchisor as set forth in Section 3(b) of the Franchise Agreement. What This Means (2025 FDD)
According to Bumper Man's 2025 Franchise Disclosure Document, a Certified Technician has the option to continue operating the Bumper Business under the Certified Technician Addendum and the Franchise Agreement for two consecutive two-year terms. However, this is contingent upon the Certified Technician satisfying the conditions required by Bumper Man, as outlined in Section 3(b) of the Franchise Agreement.
If the Certified Technician chooses not to renew the addendum but wishes to purchase a Bumper Man franchise for a new, available Designated Area, they must meet several conditions. First, the Certified Technician must satisfy Bumper Man's then-current criteria for new franchisees. Second, they cannot be in default of the Franchise Agreement and the Addendum. Finally, they must enter into Bumper Man's then-current form of franchise agreement. If these conditions are met, Bumper Man will apply the $25,000 initial franchise fee paid by the Certified Technician towards Bumper Man's then-current initial franchise fee.
It's important to note that the option to renew does not provide the Certified Technician with any exclusivity to any Designated Area, nor does it guarantee that a Designated Area will be available when the Certified Technician desires to exercise their rights. A prospective franchisee should carefully review Section 3(b) of the Franchise Agreement to fully understand the specific conditions that must be met to renew the Certified Technician Addendum.
