Background Statement:
- A. Bombs Away Franchising and its affiliate Bombs Away Brand, LLC, have created and own a system (the "System") for developing and operating a service business providing pooper scooper and pet waste management services to residential and commercial customers, under the trade name "Bombs Away".
- B. The System includes (1) methods, procedures, and standards for developing and operating a Bombs Away business, (2) particular products and services, (3) the Marks, (4) training programs, (5) business knowledge, (6) marketing plans and concepts, and (7) other mandatory or optional elements as determined by Bombs Away Franchising from time to time.
- C. The parties desire that Bombs Away Franchising license the Marks and the System to Franchisee for Franchisee to develop and operate a Bombs Away business on the terms and conditions of this Agreement.
ARTICLE 1. DEFINITIONS
- "Action" means any action, suit, proceeding, claim, demand, governmental investigation, governmental inquiry, judgment or appeal thereof, whether formal or informal.
- "Approved Vendor" means a supplier, vendor, or distributor of Inputs which has been approved by Bombs Away Franchising.
- "Business" means the Bombs Away business owned by Franchisee and operated under this Agreement.
- "Competitor" means any business which offers products or services the same or similar to the franchise brand.
- "Confidential Information" means all non-public information of or about the System, Bombs Away Franchising, and any Bombs Away business, including all methods for developing and operating the Business, and all non-public plans, data, financial information, processes, vendor pricing, supply systems, marketing systems, formulas, techniques, designs, layouts, operating procedures, customer data, information and know-how.

What This Means (2024 FDD)
According to Bombs Away's 2024 Franchise Disclosure Document, the Bombs Away System does include training programs. Specifically, the System includes methods, procedures, and standards for operating a Bombs Away business, particular products and services, the Marks, training programs, business knowledge, and marketing plans.
Bombs Away also provides pre-opening training to the Principal Executive at its headquarters or a designated Bombs Away business without charging a fee for the training itself. However, the franchisee is responsible for covering their own travel, lodging, meals, and other out-of-pocket expenses associated with attending the training. Bombs Away reserves the right to change the length and content of the initial training program based on the attendee's experience and skill level.
Bombs Away Franchising may also require the Principal Executive or other employees to complete additional training programs in any format and location they determine. Bombs Away Franchising may charge a reasonable fee for these training programs, and the franchisee is responsible for all travel, living, and other expenses if the training program requires travel. If a franchisee sends an employee to Bombs Away Franchising's training program after opening, Bombs Away Franchising may charge its then-current training fee. As of the date of the Franchise Agreement, this fee is $350 per day.
