Who is required to attend the standard pre-opening training provided by Bombs Away Franchising?

ICLE 6. LOCATION, TRAINING AND OPENING**
- 6.1 Location. Franchisee will operate the business from their home office at the address stated on the Summary Page.
- 6.2 New Franchisee Training. Franchisee's Principal Executive must complete Bombs Away Franchising's training program for new franchisees to Bombs Away Franchising's satisfaction at least four weeks before opening the Business.
- 6.3 Conditions to Opening. Franchisee shall notify Bombs Away Franchising at least 30 days before Franchisee intends to open the Business. Before opening, Franchisee must satisfy all of the following conditions: (1) Franchisee is in compliance with this Agreement, (2) Franchisee has obtained all applicable governmental permits and authorizations, (3) the Business conforms to all applicable System Standards, (4) Franchisee has hired sufficient employees, (5) Franchisee's officers and employees have completed all of Bombs Away Franchising's required pre-opening training; and (6) Bombs Away Franchising has given its written approval to open, which will not be unreasonably withheld.
- 6.4 Opening Date. Franchisee shall open the Business on or before the date stated on the Summary Page.
ARTICLE 7. OPERATIONS
- 7.1 Compliance with Manual and System Standards. Franchisee shall at all times and at its own expense comply with all mandatory obligations contained in the Manual and with all other System Standards.
- 7.2 Compliance with Law. Franchisee and the Business shall comply with all laws and regulations. Franchisee and the Business shall obtain and keep in force all governmental permits and licenses necessary for the Business.
- 7.3 Products and Services. Franchisee shall offer all products and services, and only those products and services, from time to time prescribed by Bombs Away Franchising in the Manual or otherwise in writing. Franchisee shall provide all products and perform all services in a highquality manner that meets or exceeds the customer's reasonable expectations and all applicable System Standards. Franchisee shall implement any guaranties, warranties, or similar commitments regarding products and/or services that Bombs Away Franchising may require.

What This Means (2024 FDD)
According to Bombs Away's 2024 Franchise Disclosure Document, the franchisee's Principal Executive is required to complete the standard pre-opening training program. Bombs Away Franchising will make this training available at its headquarters or at a Bombs Away business that they designate. The Principal Executive must complete this training program to Bombs Away's satisfaction at least four weeks before opening the Business.
Bombs Away does not charge a fee for this pre-opening training. However, the franchisee is responsible for covering their own travel, lodging, meals, and other out-of-pocket expenses associated with attending the training. Bombs Away Franchising retains the right to change the length and content of the initial training program based on the attendee's experience and skill level.
Furthermore, Bombs Away requires that the franchisee's officers and employees complete all required pre-opening training before opening the business. Bombs Away may also require the Principal Executive and/or any other employees to complete additional training programs at any time after opening, in any format and location determined by Bombs Away Franchising. Bombs Away may charge a reasonable fee for these post-opening training programs, and the franchisee is responsible for all travel and living expenses if the training is held at a location requiring travel.
