- 11.5 Business Data. All customer data and other non-public data generated by the Business is Confidential Information and is exclusively owned by Bombs Away Franchising. Bombs Away Franchising hereby licenses such data back to Franchisee without charge solely for Franchisee's use in connection with the Business for the term of this Agreement.

What This Means (2024 FDD)
According to Bombs Away's 2024 Franchise Disclosure Document, all customer data and other non-public data generated by the franchisee's business is considered confidential information and is exclusively owned by Bombs Away Franchising. However, Bombs Away Franchising licenses this data back to the franchisee without charge. This license is specifically for the franchisee's use in connection with operating the Bombs Away business.
The license for the business data extends for the duration of the Franchise Agreement. This means that as long as the franchisee is operating under a valid Franchise Agreement with Bombs Away, they are permitted to use the data generated by their business.
Upon termination of the Franchise Agreement, the franchisee's right to use the licensed business data also ends. This is a common practice in franchising, as the data is considered part of the Bombs Away system and is proprietary to the franchisor. The franchisee must cease using the data and return any materials containing confidential information to Bombs Away Franchising.
