What This Means (2024 FDD)

According to Bombs Away's 2024 Franchise Disclosure Document, franchisees must ensure their personnel adhere to the dress attire, uniform, personal appearance, and hygiene standards outlined in the manual. While the FDD excerpt specifies that Bombs Away can conduct business evaluations, including observing operations and speaking with employees, it does not explicitly detail the consequences of failing to meet these appearance standards. Bombs Away may set minimum score requirements for evaluations, and failure to meet or exceed the minimum score will be a default under the Franchise Agreement. Bombs Away Franchising may take action to cure the default on behalf of Franchisee, without any liability to Franchisee.

However, the FDD does state that Bombs Away Franchising may take action it deems appropriate to resolve a customer complaint regarding the Business, and Bombs Away Franchising may require Franchisee to reimburse Bombs Away Franchising for any expenses. Since appearance can impact customer perception, Bombs Away might address non-compliance through its customer evaluation and compliance programs. Franchisees are required to participate in these programs, which may include customer feedback systems, surveys, and mystery shopping, at their own expense.

Prospective Bombs Away franchisees should clarify with the franchisor the specific penalties or corrective actions that may result from non-compliance with the dress attire and appearance standards. This could include warnings, mandatory retraining, or financial penalties, depending on the severity and frequency of the violations. Understanding these potential consequences is crucial for maintaining consistent brand standards and avoiding potential disputes with Bombs Away.
